Using EntryThingy

Who Can Use EntryThingy

You may use our Services only if you can form a binding contract with EntryThingy, and only in compliance with these Terms and all applicable laws. When you create your EntryThingy account, you must provide us with accurate and complete information. Any use or access by anyone under the age of 13 is prohibited.

Registration and Account Security

You are responsible for maintaining the confidentiality of your login information and are fully responsible for all activities that occur under your account. You agree to immediately notify EntryThingy of any unauthorized use of your account.

User Content

Responsibility for User Content

You retain your rights to any content you submit, post or display on or through the Services. What's yours is yours — you own your content. By submitting, posting or displaying content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content.

Content Restrictions

You may not post or upload any content which contains material that:

• Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
• You do not have the right to make available
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights
• Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware

Services and Billing

Payment Terms

By selecting a paid subscription, you agree to pay EntryThingy the monthly or annual subscription fees indicated. Payments will be charged on a pre-pay basis on the day you sign up and will cover the use of that service for the period as indicated.

Cancellation

You are solely responsible for properly canceling your account. An email or phone request to cancel your account is not considered cancellation. You can cancel your account at any time by clicking on the Account Settings link in the user menu at the top of the screen.

EntryThingy Rights

All rights, title, and interest in and to the Services are and will remain the exclusive property of EntryThingy and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing in the Terms gives you a right to use the EntryThingy name or any of the EntryThingy trademarks, logos, domain names, and other distinctive brand features.

Disclaimers and Limitations of Liability

Disclaimers

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. EntryThingy expressly disclaims all warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall EntryThingy, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, this service.

General Terms

Modifications to Terms of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Entire Agreement

These Terms constitute the entire agreement between you and EntryThingy regarding our Services, and supersede and replace any prior agreements we might have between us.
